DISCLAIMERS / RELEASE OF CLAIMS

 BY PURCHASING AND/OR USING THE PUSH BAR SOLUTIONS GRAB AND GO BICYCLE CARRIER (THE “PRODUCT”), YOU HEREBY AGREE TO THE FOLLOWING TERMS.

 EXCEPT AS EXPRESSLY WARRANTED IN THESE TERMS, THE PRODUCT IS SOLD "AS IS" AND PUSH BAR SOLUTIONS LTD. MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE MERCHANTABILITY AND FITNESS OFTHE PRODUCT FOR A PARTICULAR PURPOSE, NOR DOES IT ASSUME ANY OTHER OBLIGATION OR LIABILITY.

 YOU ACKNOWLEDGE AND AGREE THAT USE OF THE PUSH BAR SOLUTIONS GRAB AND GO BICYCLE CARRIER MAY BE DANGEROUS AND CAN RESULT IN PROPERTY DAMAGE, INJURY, OR DEATH, AND YOU ASSUME FULL RESPONSIBILITY FOR SUCH RISKS AND/OR DAMAGES.

 YOU ACKNOWLEDGE AND AGREE THAT TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PUSH BAR SOLUTIONS LTD, OR ITS SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS (“THE PUSH BAR PARTIES”) BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE OR SPECIAL DAMAGES  ARISING OUT OF OR RELATED TO YOUR USE OF THE PRODUCT REGARDLESS OF WHETHER SUCH LIABILITY IS BASED ON BREACH OF AGREEMENT, TORT, STRICT LIABILITY, BREACH OF WARRANTIES, FAILURE OF ESSENTIAL PURPOSE OR OTHERWISE, AND EVEN IF ADVISED OF THE LIKELIHOOD OF SUCH DAMAGES. 

 TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS THE PUSH BAR PARTIES FROM ALL LIABILITIES, CAUSES OF ACTION, CLAIMS, AND DAMAGES THAT MAY ARISE IN ANY WAY FROM YOUR PURCHASE OR USE OF THE PRODUCT. 

 IF A COURT OF LAW HOLDS ANY PROVISION OF THIS AGREEMENT TO BE ILLEGAL, INVALID, OR UNENFORCEABLE, SUCH PROVISION SHALL BE DEEMED AMENDED TO ACHIEVE THE EFFECT THAT IS AS NEAR AS POSSIBLE TO THAT PROVIDED BY THE ORIGINAL PROVISION AND THE LEGALITY, VALIDITY, AND ENFORCEABILITY OF THE REMAINING PROVISIONS OF THIS AGREEMENT SHALL NOT BE AFFECTED.

Product Warnings:

The Push Bar Solutions Grab and Go Bicycle Carrier (the “Product”) is sold by Push Bar Solutions LTD, a Canadian Corporation (“Push Bar Solutions”). By purchasing and/or using the Product you agree to the following terms. 

 The Product must be used in accordance with the instructions that are found in the bag with the bike carrier and on the website www.pushbarsolutions.com, and all terms described herein.  You are solely responsible for ensuring the Product is used in accordance with the directions, and Push Bar Solutions is not liable for any damage, injury or death that occurs in connection with your failure to use the Product in accordance with the directions.  Failure to attach a bicycle properly as described in the user instructions can result in property damage, injury or death.

 It is your responsibility to use the Product in compliance with federal, state, county, and/or provincial laws and regulations, expressly including all posted speed limits and traffic laws.  You are solely responsible for seeking necessary authorization to use the Product when required by law.

 While transporting a bicycle with the Product (like any load attached to a vehicle), you must consider all driving conditions including but not limited to traffic, weather conditions, and road conditions, and regulate your speed and driving accordingly.  Vehicle handling, cornering and braking changes with a bicycle attached to the front of a police vehicle, and you need to safely adjust your driving accordingly.

 The Product cannot be used during pursuit or emergency driving, on rough terrain, or while driving at speeds in excess of 65 miles/100 kilometres per hour.

 The Product is designed for transporting a bicycle on the front of the police vehicle directly from the point of attachment to its destination.  The bicycle should not remain on the carrier for more than 10 hours.  

 Use of the Product may obstruct the visibility of the driver of the vehicle. Obstructed view could lead to damages, including but not limited to, property damage, injury, or death, including damage to the bicycle being transported and/or the police vehicle.  It may also cause an obstructed view of pedestrians in the immediate area of the police vehicle, putting others at risk.  Extreme caution needs to be exercised while operating a police vehicle with the Product and bicycle attached.  It is your sole responsibility to ensure that visibility is optimal while the Product is attached. It may be necessary to remove parts of the bike that cause an obstruction, such as seats, wheels, and accessories (such as bags).

 It is your sole responsibility to ensure that the bicycle mounted to the Product has been checked for any components that could become dislodged or disconnected while the police vehicle is moving.  Any loose components that have been removed should be stored in a safe compartment of the vehicle or trunk/hatch area while driving.

 Bicycles that weigh more than 50 pounds or at are produced or modified to include a gasoline engine or electric motor cannot be used with the Product. Bicycles that contain gasoline and electric motors may also present an obstruction of view for the driver and cause an increased fire hazard and an additional risk of property damage, injury, or death.  The Product is designed exclusively for human-powered bicycles that meet the designated specifications. 

 Carbon Fibre framed bikes and bikes built or customized with special interest components should not be carried using the Product as they be damaged during transport.

 The Product should not be mounted to a push bar if it is not being used to transport a bicycle.  It should only be mounted when in use with a bicycle attached.

 When not in use, the Product shall be stored in a dry area, inside the provided storage bag, and in a collapsed position.  If the Product should get wet, allow to dry before placing in storage bag.

 After every use, inspect the Product for any damage or imperfections to ensure it is in good working order.  In the event of damage to the bike carrier including, but not limited to:  broken plastic or metal components, broken cradle, torn straps, frayed cables, missing hardware, the bike carrier should be taken out of service and repaired before using again, or if the Product cannot be reasonably repaired the Product, must be destroyed and not resold.  

 The Product is a police-specific bike carrier and is not for general consumer sale or public use.
